Sales contract and the civil-law notary

The sales contract is a deed in which the buyer and the seller agree in writing on the arrangements they have made concerning the sale and purchase of the house. The sales contract is also referred to as a "provisional sales agreement". However, the term 'provisional' does not mean that you can simply undo the purchase. The purchase can only be undone on the grounds of resolutory conditions, if and to the extent that these have been specified in the sales contract.
A civil-law notary is also the person to turn to for drafting the sales contract if you have not engaged an estate agent. As soon as the sales contract has been signed by both parties, the following steps need to be taken:
  • you, or in most cases the estate agent, need to send the sales contract to the civil-law notary;
  • you need to finance the house;
  • the moment the civil-law notary receives the sales contract, he will draft the deed of transfer of title and, if you are taking out a mortgage loan, the mortgage deed.
